THE CONSTITUTIONAL FOUNDATION OF DIASPORA VOTING
Article 82 of the Constitution of Kenya 2010 provides the legal framework for the progressive registration of citizens residing outside Kenya. This was a landmark victory for the million-strong Kenyan diaspora, whose economic contribution through remittances is one of the nation's largest sources of foreign exchange. The Independent Electoral and Boundaries Commission (IEBC) is mandated to facilitate this right by establishing registration and voting centers at Kenyan Embassies, High Commissions, and Consulates globally.
ELIGIBILITY AND DOCUMENTATION
To be eligible to register as a diaspora voter, you must meet the following criteria:
1. CITIZENSHIP: You must be a Kenyan citizen of sound mind.
2. AGE: You must be 18 years or older at the time of registration.
3. IDENTIFICATION: You MUST possess a valid Kenyan Passport. Unlike registration within Kenya, National ID cards are generally not accepted for diaspora registration unless a specific legal amendment is announced for a particular registration drive.
THE REGISTRATION PROCESS STEP-BY-STEP
Registration currently requires physical presence at a designated IEBC center (usually an embassy). The process involves:
- BIOMETRIC CAPTURE: Your fingerprints and facial image are recorded into the Biometric Voter Registration (BVR) system.
- SELECTION OF VOTING STATION: You will specify the embassy or consulate where you intend to cast your ballot on election day.
- ACKNOWLEDGMENT SLIP: You will receive a slip as proof of registration. Keep this document safe, as it is essential for the verification phase.
WHAT THE DIASPORA CAN VOTE FOR
Under current election regulations, diaspora voters are eligible to vote for the President and in any National Referendum. They are not yet eligible to vote for local elective positions such as Governors, Senators, Members of the National Assembly (MPs), or County Assembly Members (MCAs) unless they choose to register and vote within their respective home constituencies in Kenya.

The IEBC typically announces specific diaspora registration windows. It is critical for Kenyans abroad to:

- RENEW PASSPORTS EARLY: Ensure your documents are valid and ready before the 2026/2027 registration drives begin.
- PARTICIPATE IN VERIFICATION: Use online tools to confirm your details are correctly captured in the final register. Voter verification is the only way to catch name spelling or document number errors before it is too late.
